This page sets out what you may and may not do with a theme bought from ThemeStack. It is written in plain English on purpose. Buying a theme means you accept these terms.
What you are buying
You are buying a licence to use the theme, not ownership of it. Copyright in the theme files, documentation and demo content remains with ThemeStack. The licence is perpetual for the version you bought and every version we release afterwards, and it cannot be revoked except for the breaches listed below.
Single-store licence
A single-store licence covers one live store.
You may:
- install the theme on one live, publicly reachable store that you or your business owns;
- install the same theme on any number of development, staging, preview and password-protected stores that support that one live store;
- modify the code, templates, styles and settings as much as you like for that store;
- keep using the version you have for as long as you want, with no expiry.
You may not:
- install the theme on a second live store, including a second regional store for the same brand;
- give, sell, sublicense or lend the theme files to anyone else, modified or unmodified;
- publish the theme or any substantial derivative of it in a marketplace, a repository, or as part of a service;
- remove or obscure the copyright notices in the theme files.
If you are a freelancer or an agency building for a client, buy the licence in the client's name or transfer it to them on handover. One licence follows one live store, whoever paid for it. A licence may be transferred once to the store owner at no cost; email us and we will move it.
Agency licence
An agency licence covers up to twenty-five live stores for one theme.
It carries every permission of the single-store licence, applied to each of those stores, plus the right to install the theme for clients as part of paid work. Each live store must be registered against the licence key in your account so that the activation count stays accurate.
An agency licence does not permit redistribution of the theme files outside a client engagement, and it does not permit publishing the theme as part of a product of your own. When a client relationship ends, deactivate that store's activation so the slot returns to your pool.
Agency licensing is priced per theme and is not included in Founding Access.
Founding Access
Founding Access is a one-time purchase that grants a single-store licence for every theme published during your twelve-month coverage window.
Your coverage window begins on the date of purchase and ends twelve months later. A theme is inside your window if its publication date falls on or before your window's end date. Themes published afterwards are not included.
Access to themes captured inside your window is permanent and survives the closing of the window, including all future updates to those themes. Founding Access does not include agency licensing, custom development or migration services.
Updates and support
Updates to a theme you own are included at no extra cost for as long as we maintain that theme. We will give at least twelve months' notice on this page before ending maintenance of a theme.
Support covers the theme behaving as documented. It does not cover custom code you or a third party added, conflicts caused by applications, or changes required by a platform update we have not yet shipped a response to.
Refunds
Digital downloads are excluded from the fourteen-day right to cancel once you begin the download, and you consent to that at checkout.
We refund in two cases: the theme does not work as described and we cannot fix it within a reasonable time, or you were charged twice for the same purchase. In the first case the refund is the amount paid less the payment processing fee our payment provider does not return to us; a duplicate charge is refunded in full. Contact us within thirty days of purchase.
Liability
Our total liability for any claim relating to a theme is limited to the amount you paid for it. We do not accept liability for lost sales, lost data or consequential loss. Nothing in these terms limits liability for death, personal injury or fraud, which cannot be limited under the law of England and Wales.
Breach and termination
If you breach this licence, we may terminate it after giving you fourteen days' written notice and a chance to put things right. On termination you must stop using the theme and delete the files. Terminating a licence does not entitle you to a refund.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
ThemeStack is an independent theme studio and is not affiliated with Shopify Inc. Our themes are compatible with Shopify stores; that compatibility is not a partnership and implies no endorsement.
